Strava | Developer Summit Event Participant Waiver

STRAVA, INC.
RELEASE AND DISCLAIMER OF LIABILITY

This Release and Disclaimer of Liability is entered into between Strava, Inc. (together with its subsidiaries, the “Company”) and (“Participant”). The Company sponsors various activities and events (each event or activity, an “Event”).

1. Participant represents and warrants that he/she is fully aware of the risks and hazards connected with the Event and is aware that such activities include the risk of injury and even death, and hereby elects to voluntarily participate in the Event, knowing that the activities may be hazardous. Participant understands that the Company does not require the Participant to participate in this activity. Participant voluntarily assumes full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by Participant, or any loss or damage to property owned by Participant, as a result of being engaged in the Event, whether caused by the negligence of the Company or otherwise, to the fullest extent allowed by law.

2. Participant hereby agrees to RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Company, its parent company, subsidiaries, affiliates, officers, agents, servants, or employees, or other participants (“Releasees”) (the “Releasees”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Participant, or to any property belonging to the Participant, while participating in the Event, while in, on or upon the premises where the Event takes place, or otherwise, REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY THE NEGLIGENCE OF THE RELEASEES and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, to the fullest extent allowed by law. Participant further agrees TO INDEMNIFY AND HOLD HARMLESS the RELEASEES from any loss, liability, damage, or costs, including court costs and attorneys’ fees that the Releasees may incur due to his/her participation in the Event, WHETHER CAUSED BY NEGLIGENCE OF RELEASEES or otherwise, to the fullest extent allowed by law.

3. Participant hereby grants to Company, its legal representatives, assignees, and those acting under its authority, the unrestricted, perpetual, worldwide and irrevocable right and permission to copyright and/ or use, and/or publish photographic or video portraits or pictures of Participant taken at the Event (the “Pictures”), and the negatives, transparencies, prints, or digital information pertaining to them, in still, single, multiple, moving or video format, or in which Participant may be included in whole or in part, or composite, or distorted in form, or reproductions thereof, in color or otherwise, in any media for advertising or any other lawful purpose and in any medium now known or hereafter devised. Participant hereby relinquishes any right that he/she may have to examine or approve the Pictures or the marketing copy or printed matter that may be used in. Participant waives any ownership and publication right he/she might be entitled of in connection with the Pictures and agrees he/she has no right to sell, license or publish any of the Pictures. Participant releases the Releasees from any claims for remuneration associated with any form of damage, foreseen or unforeseen, associated with the proper commercial or artistic use of the Pictures unless it can be shown that said reproduction was maliciously caused. Participant also waives any and all claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, that may be sustained by Participant, or any of the property belonging to Participant, whether caused by the negligence of the Releasees, or otherwise. It is the express intent of Participant that this document shall bind Participant’s heirs, assignees and personal representatives. Participant represents that he/she is 18 year or older, that the Pictures were taken in a completely proper and highly professional manner, and this release was willingly signed.

5. Participant acknowledges that he/she has read the foregoing Release and Disclaimer of Liability, and acknowledges and agrees that his/her participation in the Event is subject to the terms hereof.
