Formula Fixed Qualifying Series Accident Waiver and Release of Liability

READ THIS DOCUMENT CAREFULLY BEFORE SIGNING. THIS DOCUMENT HAS LEGAL CONSEQUENCES AND WILL AFFECT YOUR LEGAL RIGHTS AND WILL ELIMINATE YOUR ABILITY TO BRING FUTURE LEGAL ACTIONS.

Acknowledgement of Risks
I acknowledge and fully understand that the Formula Fixed Qualifying Series (the “Event”) is an athletic competition that is an extreme test of a person’s physical and mental limits and carries with it the inherent and significant risk of serious injury, permanent disability, death, and/or property damage or loss.
I understand that these risks may result from, but are not limited to:
The nature of competitive bicycle racing, including high speeds, close proximity to other riders, and unpredictable movements;
Terrain, facilities, road surface conditions, weather, temperature, and visibility;
My own actions, inactions, or negligence;
The actions, inactions, or negligence of other participants, spectators, volunteers, officials, event staff, and/or the organizers;
Equipment failure, mechanical issues, and lack of hydration;
Unforeseen or presently unknown risks, including those not reasonably foreseeable at this time.

I acknowledge these risks are not only inherent to athletes, but also to volunteers and spectators, and that I freely and voluntarily assume all such risks.

Participant Representations
I certify that:
I am at least 18 years of age (or have provided a fully executed parental/guardian consent form if under 18);
I am physically fit, have sufficiently trained for this Event, and have not been advised otherwise by a qualified medical professional;
I have no medical or physical condition that could interfere with my safety or the safety of others;
I have read, understand, and will comply with all Event rules and safety instructions.

I agree not to engage in conduct that unreasonably endangers myself, other participants, spectators, or any member of the public.

Release, Waiver, and Covenant Not to Sue
On behalf of myself, my heirs, executors, administrators, next of kin, successors, and assigns, I hereby:
Waive, release, and forever discharge Formula Fixed Gear Racing Inc., officers, employees, volunteers, sponsors, agents, contractors, venue owners, local government entities, and any other persons or entities associated with the Event (“Releasees”) from any and all claims, liabilities, demands, or causes of action, known or unknown, arising out of or in any way connected with my participation in the Event, including those caused by the negligence of the Releasees;
Covenant not to sue any of the Releasees for any injury, death, property damage, or other loss connected with the Event;
Agree to indemnify and hold harmless the Releasees from any claim brought by me or on my behalf, or by any third party, arising from my participation in or travel to/from the Event.

Medical Authorization
I consent to receive medical treatment deemed necessary in the event of injury, accident, and/or illness during the Event and accept full financial responsibility for such treatment. I authorize the release of medical information to Event personnel, insurance carriers, and medical providers as necessary.

Equipment & Safety
I accept full responsibility for the condition and adequacy of my bicycle and all other equipment. I agree to wear a helmet and appropriate protective gear at all times while participating in the Event, or alternatively, I expressly assume the risk of not doing so.

Media Release
I grant to the Event organizers and their designees the unrestricted right to use my name, image, likeness, voice, and biographical information in any broadcast, telecast, photograph, video, or other recording for any legitimate purpose, without compensation, notice, or further consent.

Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from this Agreement or my participation in the Event shall be brought exclusively in the courts of Maryland.

Severability
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

I HAVE CAREFULLY READ THIS AGREEMENT, UNDERSTAND ITS TERMS, AND SIGN IT VOLUNTARILY, KNOWING THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS.

For Participants Under 18 Years of Age:
I am the parent or legal guardian of the above-named Minor Participant. I have read and understand this Agreement, and I consent to its terms on my own behalf and on behalf of the Minor Participant.
