2026 RVAR Liability Waiver

Assumption of Risk, Release of Liability, Covenant Not to Sue, and Indemnification Agreement

This Assumption of Risk, Release of Liability, Covenant Not to Sue, and Indemnification Agreement ("Agreement") is entered into by the undersigned participant ("Participant") in connection with participation in any bicycle race, cycling event, training activity, or related program (collectively, the "Event") organized, hosted, or sponsored by RVA Racing LLC and RVA Racing Events LLC (collectively, "Released Parties").
1. Acknowledgment and Assumption of Inherent Risks
Participant acknowledges that cycling, racing, and related activities involve inherent risks, including but not limited to:
Collisions with other participants, vehicles, animals, or obstacles;
Falls, crashes, mechanical failures, hazards from terrain or weather;
Physical exertion, dehydration, heat/cold stress, and other environmental conditions;
The negligent acts or omissions of other participants, spectators, or third parties.
Participant voluntarily assumes all risks, known and unknown, associated with participation in the Event, including those that may result in property damage, personal injury, serious injury, or death.
2. Release of Liability
In consideration for being permitted to participate in the Event, Participant hereby releases and discharges the Released Parties, including their owners, officers, directors, members, employees, volunteers, contractors, insurers, sponsors, landowners, affiliates, and agents, from any and all claims, liabilities, demands, actions, or causes of action arising from or related to Participant’s participation in the Event, whether caused by negligence of the Released Parties or otherwise.
This Release includes, but is not limited to, claims for:
Personal injury, bodily harm, or death;
Property loss or damage;
Economic losses;
Any other damages arising from participation in the Event.
3. Covenant Not to Sue
Participant agrees that they will not initiate or maintain any lawsuit, claim, or legal action against the Released Parties for any injury, loss, or damage arising from or connected to the Event. Should Participant breach this Covenant, Participant agrees to be responsible for all attorneys’ fees and costs incurred by the Released Parties in defending such claims.
4. Indemnification and Hold Harmless
Participant agrees to indemnify, defend, and hold harmless the Released Parties from any claims, demands, damages, losses, or expenses (including attorneys’ fees) brought by third parties or arising out of:
Participant’s actions or omissions during the Event;
Damage to property caused by Participant;
Injury to other participants or third parties caused by Participant.
5. Health and Safety Certification
Participant certifies that:
They are physically fit and capable of safely participating in the Event;
They will use equipment (including bicycle and protective gear) that is properly maintained and appropriate for the Event;
They will comply with all Event rules, safety instructions, and applicable laws.
Participant assumes full responsibility for their own medical expenses and emergency medical care, if needed.
6. Consent to Medical Treatment
Participant authorizes Event personnel, volunteers, or emergency responders to secure medical treatment deemed necessary. Participant releases the Released Parties from any liability arising from such treatment.
7. Media and Photography Release
Participant grants the Released Parties the right to use photographs, videos, and other media of Participant from the Event for promotional, commercial, or educational purposes, without compensation.
8. Binding Effect; Governing Law
This Agreement:
Is binding upon Participant, their heirs, executors, administrators, and assigns;
Is intended to be as broad and inclusive as permitted by applicable law;
Shall be governed by and interpreted under the laws of the Commonwealth of Virginia.
If any portion of this Agreement is found unenforceable, the remainder shall continue in full force and effect.
9. Participant Acknowledgment
By signing below, Participant affirms that they:
Have read and fully understand this Agreement;
Understand that they are giving up substantial legal rights, including the right to sue;
Are signing this Agreement freely and voluntarily, without inducement or coercion.
